This form has been prepared to inform the consumer about the essential matters before a distance sale/service transaction is concluded through Pitemati and before payment is made. The product/service and price information displayed on the order screen, together with order-specific legal circumstances, form an integral part of this form.
1. Essential Characteristics of the Product or Service
The name, type, scope, license type, method of delivery/performance and, where applicable, customer-specific project terms of each purchased item are displayed on the order screen. For customer-specific offers, the type of work (for example, web design, custom software/module, audio transcription), scope, deliverables and special conditions are also specified.
2. Total Price and Payment
The total amount including taxes and any additional charges separately approved by the consumer are displayed before payment. Payment may be made by bank transfer/EFT, PayTR card payment or other payment methods enabled on the website. Confirmation of the order creates an obligation to pay.
3. Delivery / Performance
Ready-made digital products are made electronically accessible after payment confirmation, depending on the nature of the product. For services, the delivery/performance period and scope are specified for the particular order; delays by the customer in providing the required information, content and access may affect the relevant period.
4. Right of Withdrawal - Item-Based Application
The consumer has a 14-day right of withdrawal for distance contracts for which no exception is provided under applicable legislation. Products and services with different legal characteristics may be included in the same order. Therefore, the right of withdrawal and its exceptions are assessed separately for each order item according to its own nature; an exception or specific consent relating to one item does not automatically apply to other items.
5. Order-Specific Legal Profiles
- Immediate digital delivery profile: Information concerning the statutory exception to the right of withdrawal for services performed immediately in electronic form or intangible goods delivered immediately to the consumer is displayed only for the relevant digital product items.
- Early-commenced service profile: If performance of a service is to begin before the 14-day period has expired, the consumer's separate express request/consent is obtained by clearly identifying the relevant service or services by name.
- Standard service profile: For services for which no consent for early commencement has been given and which do not fall within another exception, the general right of withdrawal applies; the customer is not asked to provide consent in the form of a “waiver of the right of withdrawal”.
6. Withdrawal Notification
Where the right of withdrawal applies, the notification may be submitted to iletisim@pitemati.com in writing or through a durable medium. Refunds are made in accordance with the periods and methods prescribed by applicable legislation and, as a rule, using a method corresponding to the payment instrument used for the purchase.
7. Customer-Specific Product and Service Offers
A customer-specific offer may be assigned only to the relevant customer account and may not be visible in the public store. This does not alter the nature of the sale. The scope, price, estimated period, revision limits, third-party costs and applicable legal profile are displayed to the customer before the order is placed. If a customer-specific offer contains both a digital product and a service component, the components are identified separately wherever possible.
8. Disputes and Available Remedies
The consumer's rights to apply to the Consumer Arbitration Committees and Consumer Courts remain reserved within the applicable jurisdictional and monetary limits in force.
9. Confirmation
Before placing the order, the consumer confirms that they have read and received this preliminary information and the order-specific information, and that confirmation of the order creates an obligation to pay. Statements that produce specific legal consequences, such as an exception to the right of withdrawal or early commencement of a service, are obtained separately only when necessary and in a manner that clearly identifies the relevant items.
