Summary
This license explains the terms of use determined for each product offered for sale. Pitemati Individual License (Standard License) grants the customer who purchases a digital product a perpetual and non-transferable license, subject to the specified usage rules.
License Terms
- Scope and Right of Use: This license grants the right to use a product for a single final project or work (“End Product”). You may use the product in your own personal projects or in a client project. A separate license is required for each product.
- Definition of End Product: For a template-based product, the end product is the version of the product customized with content and design for a personal or commercial project.
- For other products, the end product is a larger work created by combining the product with other elements.
- Single Use Right: Only one end product may be created with one license.
Permitted Legal Uses
- You may create an end product on behalf of a client. The client may take ownership of the end product, but this license is transferred on the following condition: the end product may not be resold.
- If the end product is shared free of charge, any number of copies may be created.
- You have the right to modify the product and create derivative works. However, the resulting derivative work remains subject to the terms of this license.
Prohibitions and Restrictions
- You may sell your end product to only one client. If you want to resell it, a Commercial license is required.
- You may not redistribute the product, whether in its original form or with superficial changes, as a stock item, template, or source file.
- You may not use the product in “on-demand,” “custom order,” or “do-it-yourself” type applications. A separate license is required for each product.
- You may not extract only one component of the product and use it independently in another project.
- You may not allow the end user to use the product outside the end product.
- You may not use the product as a logo or trademark.
Additional Rules
- Some product components may be subject to different licenses (Creative Commons, GPL, etc.). In such cases, the license information for the relevant component will be specified in the product files.
- If all or part of the products are under an open-source license, those licenses apply to the relevant components, and the open-source license will prevail if it conflicts with these license terms.
- You may not use the products for illegal or unethical purposes. You may not associate items containing a person or registered brand with defamation, obscenity, or sensitive subjects.
- If this license is violated, your right to use the product may be terminated.
All intellectual property rights belong to the author. This license grants you only the right to use the product under the stated terms.
Pitemati Commercial License Agreement
Key Terms
- The Commercial License grants the purchasing customer (hereinafter referred to as the “User”) the right to use a specific Digital Product (hereinafter referred to as the “Product”) on a perpetual, non-exclusive, and worldwide basis. This license includes the details and limitations regarding the use of the Product.
- The User may use the Product only to create a single End Product for themselves or for one client. The created End Product may be sold or licensed commercially.
- End Product: For a template-based Product, the End Product is a customized application. For example: if the Product is a website theme, the End Product is the final website customized with your content.
- For other Product types, the End Product is a broader work that includes the Product and is different in nature from the Product. For example: if the Product is an icon set, the End Product is a mobile application offered for sale.
User Rights
- Prohibition of Multiple Use
This license may not be used to create more than one End Product with one Product. A separate license must be purchased for each unique End Product.
Example: If you use the same website template for multiple clients, a separate license is required for each client. - Prohibition of Redistribution:
You may not sell, share, or redistribute the Product as-is or modified as a stock product, source files, tool, template, or package. Offering the Product as part of another Product is also subject to this prohibition.
Examples:
You may not include and sell a licensed icon set in a stock image collection.
It is prohibited to resell a template as another template by making only superficial changes.
- Prohibition of Use in On-Demand Products or Customization Platforms
You may not use the Product in applications or services that allow users to create or customize their own personal products. Such use requires a separate license for each user.
Examples:
You may not integrate the Product into a website builder tool and offer template options to customers so that they can create their own websites.
Special licensing is required to use it in services such as print design platforms where users can upload and customize their own designs (e.g., T-shirt or business card design sites).
Restrictions
- This license is not a multiple-use license. A separate license is required for each unique End Product.
- You may not redistribute the Product with source files or as stock, or turn it into a template or tool.
- You may not use the Product on “on-demand” or “made-to-order” personal customization platforms.
Additional Terms
- Components extracted from the End Product may not be used separately.
- You may not use the Product as a trademark, service mark, or logo.
- You may use the Product only for legal purposes. Use for sensitive or unethical purposes is prohibited.
The Product may contain components protected by other licenses. In such cases, the relevant licenses also apply separately.
